Will of John Fordyce, Sr.


John Fordyce Srs. Will

Senacaville Guernsey Co. Ohio     October 21st 1845

I John Fordyce being sick and feeble in Body but of sound and disposing mind do now make this my last will and Testament to wit

1st    It is my will that all my just debts be paid as soon as they can conveniently

2nd    It is my will that my son Corbly have the undivided one half of the tract of land on which he now resides said to Contain 240 Acres more or less, for the sum of twelve hundred Dollars to be paid in equal annual payments in ten years from the date of my decease

3rd    It is my will and I hereby direct my Executors to sell all that tract of land purchased by me from Isaac Quinlan said to contain 92 acres and to make deed to the purchaser for the same. And the money arising from said sale to be applied to paying my legatees

4th    It is my will that my son Joseph have that tract of land on which he now resides Known as the Curtis farm by paying the sum of twenty five hundred Dollars therefor in ten years from the date of my decease in equal annual installments and if he refuse to take it, I hereby order my Executors to sell and convey the same.

5th    I hereby will and bequeath to Nancy Rose One thousand Dollars to be paid within ten years after my decease.

6th    I hereby will and bequeath to Hetty Evans one thousand Dollars to be paid within ten years after my decease

7th    It is my will and I hereby direct my Executors to sell all my other lands in Greene and Fayette Countys and elsewhere and that the proceeds of the same together with that arising from my personal effects after payment of all just debts, be equally divided between the following children Rachel Bowen, James H. Fordyce, Corby Fordyce, Nancy Rose, John Fordyce Jr., Abner Fordyce, Hetty Evans, Joseph Fordyce, Benson Fordyce.

8th    I hereby appoint James H. Fordyce and Abner Fordyce to be executors to execute and carry into effect this my last will and testament.

In testimony whereof I herunto set my hand and seal the day and year first above mentioned

Greene County S. S.

By The Tenor of These Presents I, William W. Sayers Esq. Register for the probate of Wills and granting letters of administration in and for the County of Greene in the Commonwealth of Pennsylvania do make known unto all men that on the day of the date hereof at Waynesburg before me was proved, approved and insinuated the Last Wills and Testament of John Fordyce late of Whiteley Township deceased ( a true copy whereof to these presents annexed) he having whilst he lived and at the time of his death divers goods chattels, rights and credits within the said Commonwealth by reason whereof, the approbation and insinuation of the said Last Will and Testament and the Committing the Administration of all and singular the goods chattels, rights and credits which were of said deceased and also the auditing the accounts, Calculations and reckonings of the said administration and a final dismission from the same, to me manifestly Known to belong, and that administration of all and singular the good chattels rights and credits of the said deceased, any way concerning Last Will and Testament was Committed to James H. Fordyce and Abner Fordyce in the said Testament named, they having first been duly affirmed well and truly to administer the goods chattels rights and credits of the said deceased, and make a true and perfect Inventory thereof and exhibit the same into the Registers Office at Waynesburg aforesaid within one month from the date hereof, and to render a true and just Calculation and reckoning of the said Administration within one year from the date hereof or when thereunto lawfully required and shall well and truly comply with the Laws of this Commonwealth relating to Collateral Interitances.

In Testimony whereof I have hereunto set my hand and caused the seal of said Office to be hereunto affixed. Dated at Waynesburg the 24th day of May, in the years of our Lord One thousand eight hundred and forty Eight.

Ohio County Court June Term 1855

A Copy of the last will and testament of John Fordyce Snr. deceased was this day produced in Court authenticated under the hand and official seal of William W. Sayers Register for the Probate of Wills, and granting letters of administration in the County of Greene in the Commonwealth of Pennsylvania. And the Court having seen and inspected the same, and being of opinion that said will is duly authenticated and proved, the same is ordered to be recorded in this Court.
